You may use the Site only for lawful purposes and in accordance with these Terms.

You may not:

• Disrupt or interfere with the operation or security of the Site
• Attempt to gain unauthorized access to the Site, accounts, servers, or related systems
• Introduce viruses, malware, or other harmful technology
• Use the Site to submit false, fraudulent, misleading, or unlawful information
• Impersonate another person, dealer, company, or organization
• Use automated systems to scrape, extract, copy, or collect Site content except as authorized by us or permitted through the Site’s robots.txt file
• Reproduce, sell, resell, or commercially exploit Site content without authorization
• Use Site materials to create or support competing products, services, or resources without written permission

Search engines and other authorized services may access the Site as permitted by our technical settings.

The Site and its content are owned by, licensed to, or used with permission by Doughboy Vinyl Technologies, LLC.

Authorized dealers and pool professionals may use downloadable forms, measurement resources, pattern materials, and other dealer resources for their intended business and customer-support purposes.

You may not:

• Remove copyright, trademark, or ownership notices
• Modify Site content in a misleading manner
• Represent Site content as your own
• Resell or broadly redistribute Site content
• Use DBVT trademarks, logos, pattern imagery, or proprietary dealer materials without authorization

Dealer applications submitted through the Site are subject to review and approval by DBVT.

Submitting an application:

• Does not guarantee approval
• Does not create a dealer relationship
• Does not obligate DBVT to provide products, pricing, credit, or services
• Does not replace a separate dealer agreement

Approved dealer relationships may be governed by separate agreements, policies, price lists, order terms, or other written documents.

If a separate written agreement conflicts with these Terms, the separate agreement controls for the subject it addresses.

The Site does not, by itself, create a binding product order or sales agreement.

Product orders, pricing, payment terms, production schedules, lead times, shipping terms, and delivery arrangements are established through:

• Approved quotes
• Order confirmations
• Dealer agreements
• Direct communication with our sales team
• Other applicable written documents

Product specifications, patterns, pricing, and availability displayed on the Site may change without notice.

Changes to the public Site do not modify an already accepted order except as permitted by the applicable quote, order confirmation, dealer agreement, or other written agreement.

The Site may provide product descriptions, measurement resources, installation guidance, warranty summaries, and other educational material.

This information is general in nature and should not replace:

• Product-specific instructions
• Approved measurements
• Accepted order specifications
• Jobsite evaluation
• Professional installer judgment
• Applicable laws, codes, or regulations
• Direct technical guidance provided by DBVT

You are responsible for reviewing and following the instructions and documentation applicable to the specific product and project.

Any product warranty offered by DBVT is governed exclusively by the applicable written warranty document.

Website descriptions, summaries, illustrations, frequently asked questions, or other general information do not create or expand a product warranty.

The following Site disclaimer applies only to the Site and its content. It does not alter an express written product warranty issued by DBVT.

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

DBVT DISCLAIMS WARRANTIES RELATING TO THE SITE, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• THE SITE WILL ALWAYS BE AVAILABLE
• THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE
• ALL CONTENT WILL ALWAYS BE COMPLETE, CURRENT, OR ACCURATE
• THE SITE WILL BE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS

This disclaimer applies to the public Site and does not replace specific written agreements, accepted orders, or express written product warranties.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DOUGHBOY VINYL TECHNOLOGIES, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING SOLELY FROM YOUR USE OF, OR INABILITY TO USE, THE PUBLIC SITE OR ITS CONTENT.

THIS MAY INCLUDE LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL.

TO THE FULLEST EXTENT PERMITTED BY LAW, DBVT’S TOTAL LIABILITY FOR A CLAIM ARISING SOLELY FROM USE OF THE PUBLIC SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

This limitation does not replace or alter liability terms contained in a separate dealer agreement, accepted order, written warranty, or other written agreement.

Some jurisdictions may not allow certain exclusions or limitations, so portions of this section may not apply in every situation.

The Site may contain links to websites or services operated by third parties.

DBVT does not control and is not responsible for:

• Third-party content
• Third-party privacy practices
• The availability or security of third-party websites
• Products, services, or statements offered by third parties

A link does not necessarily constitute endorsement by DBVT.

You are responsible for information submitted through the Site or sent to DBVT using contact forms, dealer applications, warranty forms, email, or other methods.

You agree that information you submit will be accurate and that you have the authority to provide it.

Do not submit:

• Unlawful content
• Malicious files or code
• Information you are not authorized to disclose
• Unnecessary sensitive financial information
• Content that infringes another person’s rights

Submission of photographs, testimonials, marketing materials, or other content does not automatically grant DBVT permission to use that material publicly. Any public marketing use should be governed by separate authorization or agreement.

We may suspend, restrict, or terminate access to the Site or protected resources when reasonably necessary to:

• Protect the Site or our systems
• Prevent misuse
• Enforce these Terms
• Comply with legal requirements
• Protect DBVT, its customers, dealers, employees, or users

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.

Any legal action relating to these Terms or use of the Site shall be brought in:

• The applicable state courts located in Gibson County, Tennessee; or
• The United States District Court for the Western District of Tennessee, Eastern Division

You consent to the jurisdiction of those courts to the extent permitted by applicable law.

We may update these Terms from time to time.

Changes will be posted on this page with an updated “Last Updated” date. Material changes will become effective when posted or on the later effective date identified in the revised Terms.

Your continued use of the Site after revised Terms become effective constitutes acceptance of the updated Terms.
